Leamington company fined for 2022 workplace accident

The Ontario Ministry of Labour has announced a fine for a Windsor-Essex company for an incident that injured an employee.

South Essex Fabricating Ltd. of Leamington was fined $65,000 after pleading guilty last week in a Windsor court.

The fine was announced on Thursday.

According to the Ministry, the incident occurred on November 4, 2022. Three employees were at a worksite repairing a stormwater drainage pipe, which was inside a trench.

One of the workers entered a 23-foot section of the pipe when one of the trench walls collapsed. The employee suffered critical injuries.

"An investigation by the Ministry of Labour, Immigration, Training and Skills Development found that the company failed to shore the walls of the trench," read the report from the Ministry. "Accordingly, the company committed the offence of failing, as an employer, to ensure that the measures and procedures prescribed...were carried out."

The company, which fabricates commercial greenhouse structures and pre-engineered buildings, was also hit with a 25 per cent surcharge, which will go to a fund supporting victims of crime.
