Irek Kusmierczyk has filed an application for a judicial recount of the votes in Windsor-Tecumseh-Lakeshore.
"We simply want to make sure that residents have 100 per cent confidence in the outcome of this election," said Kusmierczyk.
On April 28, over 70,000 people cast their ballot in the riding. The difference between Liberal Kusmierczyk and Conservative Party candidate Kathy Borrelli, who was declared the winner of the election, was 77 votes.
According to Elections Canada, there were 536 rejected ballots.
"We feel very strongly that there is evidence that of those ballots that were rejected, many of them were rejected wrongfully," said Kusmierczyk.
The hearing for the recount is scheduled for noon on Friday. The judge will make a decision on whether to proceed based on the evidence provided.
If granted, the judicial recount would be held shortly after the initial hearing.
"I want to make it absolutely, abundantly clear that absolutely and unequivocally we will respect the result of the judicial recount but we are absolutely committed to moving forward with this process," said Kusmierczyk.
