Two men charged in connection with the death of an Owen Sound restaurant owner are facing the possibility of extradition to Canada.
A total of three men have been charged in connection with the death of Sharif Rahman, who was attacked outside of the Curry House on August 17, 2023 and died a week later in hospital from injuries.
Robert Evans Jr., 24, already faces the possibility of extradition, having been charged with manslaughter. In order to face extradition, a charge must also be an offence under Scottish law, and manslaughter is similar culpable homicide.
CBC has reported that Edinburgh Sheriff Court ruled this week that 47-year-old Robert Busby Evans, and 54-year-old Barry Evans could also face extradition for their charges of being accessories after the fact.
A sheriff ruled that both men's charges would have constituted an offence in Scottish law, for attempting to defeat the ends of justice.
However the an extradition hearing date has been moved from Aug. 14 to Oct. 20. The defence argued that conditions in Ontario jails are so poor it would breach the men's human rights, so courts are awaiting a report on local jail conditions.
