A contracting company based in Brussels has been fined $150,000 after a worker was killed at a job site just west of Listowel in May of 2018.
Kurtis Smith Excavating Inc. plead guilty and was fined $150,000 by Judge Katherine Stacy Neill in provincial offences court in Stratford. The court also imposed a 25% victim fine surcharge as required by the Provincial Offences Act.
According to the court bulletin, a worker was killed when a 1,600-pound bollard made of steel and cement fell into an excavation and struck a worker.
A Ministry of Labour investigation determined that the bollard had slipped out of the choked chain wrapped around the handle and there were no safety catch mechanisms in place and none of the workers had received hoisting or rigging training.
