Huron County Man Sentenced For Uttering Threats

A Huron County man has been sentenced to 45 days house arrest and 18 months probation in connection with uttering threats.

Terry Brake of East Wawanosh will also have to pay a $100 fine.

Brake was convicted in November of one count of uttering threats to cause death stemming from an incident back in February of 2014 involving a Huron County forest conservation officer.

At today's sentencing hearing in Goderich, the defence pointed out his client had no previous criminal record and incarceration would be excessively punitive without serving any real purpose. The crown asked for three months of incarceration followed by three years of probation. The Crown argued that without incarceration the County's Forest Conservation Officer would still have to deal with Brake in the performance of his job.

The judge settled on a compromise of 45 days of house arrest with exceptions for medical and legal appointments, no direct contact with the county forest conservation officer without the presence of legal counsel and 18 months of probation.
