Chatham fatal crash trial delayed again

For a second time this week, the trial for a Windsor man accused of a deadly crash near Chatham during Retrofest in 2022 was postponed.

On Wednesday, the start of Brett Iler's trial was adjourned again at Chatham-Kent's Provincial Offences Court in Blenheim.

The 28-year-old's trial is now expected to start on March 26, 2024.

The opening day of the trial was initially scheduled for Monday, but the court heard that Iler had shoulder surgery scheduled after a fall at his home in late February. He told the court he just found out about the surgery date last week.

On Wednesday, the court heard that he is on medication after his shoulder surgery on Monday. The judge was not impressed with the case being delayed, but the crown did not oppose the adjournment motion by the defence and it was reluctantly granted.

Iler was charged with two counts of careless driving causing death and three counts of careless driving causing bodily harm after a four-vehicle crash just outside of Chatham that killed two people and injured three others on May 27, 2022.

Investigators said the man was driving east on Queen’s Line at Dillon Road when his vehicle crashed with a pickup truck travelling westbound. The man’s vehicle then hit an older-model Buick that had five people inside. Two of the occupants in the Buick died at the scene.
