Chatham shooter will know his punishment later this month

A man involved in a shooting in Chatham two years ago will have to wait until the end of the month to get sentenced.

The court heard sentencing submissions from Terry St. Hill's defence lawyer and the prosecution on Thursday, but Justice Paul Kowalyshyn said he needed more time to render his decision because so much new information was brought forward.

Sentencing submissions for the 21-year-old were to be heard on Monday, but the hearing was delayed because the defence was still waiting on institutional records from the jail in Penetanguishene to back his argument for enhanced credit for time spent during pre-sentencing due to COVID-19 lockdowns in jail.

St. Hill was initially charged with attempted murder, but pleaded guilty to discharging a firearm with the intent to endanger life at the end of September and pleaded guilty in May to killing a dog during the shooting in Chatham on January 26, 2021.

St. Hill is one of five people who were accused of attempting to murder three men from Chatham on Harvey Street in Chatham in January of 2021.

The court previously heard St. Hill fired four shots and that the shooting started with a social media dispute where threats were made against the Chatham victims before the accused all jumped in a car and drove from Cambridge to settle a score.

On Thursday, Assistant Crown Scott Kerwin said the sentence sought by the defence, in the range of five years is, "woefully inadequate and unfit" because St. Hill followed through on his threat to "put a bullet" in the chest of the victim. Kerwin is asking for 7-8 years behind bars, adding St. Hill was lucky no one was killed.

He's also asking for a DNA sample from St. Hill, a lifetime ban on weapons, and no contact with the three targets or the four co-accused.

"This conduct ought to be denounced," said Kerwin.

Kerwin said no enhanced credit is warranted because St. Hill wasn't triple bunked while in jail and didn't sleep on the floor like some prisoners had to do in other jails.

The original sentencing hearing was set for August 31, 2022.

Justice Kowlayshyn is expected to have St. Hill's sentencing decision on February 27, 2023.
