CK man found guilty following OSPCA investigation

A 41-year-old man is banned from owning a pet for a few years after allowing a dog to suffer without seeking proper treatment for the pup.

A court ruling on Wednesday found Richard Magnan guilty of permitting an animal to be in distress. As a result, he has been banned from owning or carrying for an animal for five years and will have to pay a $1,000 fine.

The Chatham-Kent man was charged back in August 2018 with four counts of animal cruelty following an OSPCA investigation.

Officers were called after someone reported seeing a one-year-old, medium-sized dog that was not able to put weight on one of its hind legs. The pup was removed from the owner’s care on May 2, 2018 under a non-compliance order from the Lambton-Kent SPCA. A veterinarian found that the dog had multiple fractures from "direct trauma to the pelvis and leg region."

The Sarnia Humane Society provided the dog with the necessary surgery and care that it needed.

"Owning an animal comes with the legal responsibility of caring for them when in need not only when convenient," said Agent Ryan Sparks, Lambton-Kent SPCA Investigations. "Permitting an animal to suffer and be in distress is absolutely not acceptable."

Although the dog did suffer for a while, it appears life is now a little brighter for the pup. Sparks said the dog was cleared by a veterinarian and has since been adopted to a new home.
