Chatham-Kent OPP say they were able to catch up with an impaired driver on Hwy. 401 after his vehicle ran out of gas.
Police say at midnight on Monday, December 18, a vehicle ran out fuel on the 401 near Bloomfield Rd. and called for a tow to bring gas.
Officers suspected the driver had been drinking, and the 37-year old Kingsville man was taken to headquarters for further tests.
As a result of those tests, he has been charged with driving while impaired and driving with a blood-alcohol content that's higher than the legal limit.
